Terms of Use
- The service provider is Gobbler Private Limited (UEN 201021339R) of 7030 Ang Mo Kio Avenue 5, #05-55 Northstar @ AMK, Singapore 569880 ("Gobbler").
- Gobbler acts as a facilitator to help you, the user of Gobbler's website, gain access to offers provided by third party sellers of goods and services ("Merchants"), and to help the Merchants promote their goods and services. Gobbler has independent relationships with you and with the Merchants.
- This User Agreement ("Agreement") is a contract between you and Gobbler and applies to your use of the facilities and services made available through Gobbler's website ("Services"). This is an important document, which you must consider carefully when choosing whether to use the Services at any time. If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access the Services.
- Information on how to transact and use the Services can be found on Gobbler's website and forms part of this Agreement. Utilization of or participation in the Service is deemed acceptance of the terms and conditions ("Terms and Conditions") set out in this Agreement.
- The Terms and Conditions may be changed from time to time. Any material changes will be posted on this website. You may review the prevailing Terms and Conditions prior to initiating a transaction at any time. In addition, when using the Services, you agree that you are subject to any policies or rules which are posted in conjunction with the Services. All such posted policies or rules are hereby incorporated by reference into the Terms and Conditions.
- To use the Services, you must be at least 18 years of age and have an account with Gobbler with a valid email address. Your account must be an active account in good standing, and you must have provided us with your current contact information.
- Gobbler reserves the right to deny access to the Services to any individual for any reason or no reason at all. Gobbler may close, suspend, or limit your access to your account or the Services.
- Registering on Gobbler's website to create an account is required in order to use the Services. By registering, you authorize Gobbler, directly or through third parties, to make any inquiries Gobbler may consider necessary to validate your identity and registration. However, because user verification on the Internet is difficult, Gobbler cannot and does not guarantee any user's identity.
- Once you finish registration, you will be identified via a user name and password, to enable you to participate in and use the Services. The password must be kept confidential and Gobbler must be notified at once if you become aware of any unauthorized use of your email address or any breach of security.
- You agree that Gobbler shall regard any transaction undertaken using the user name and password unique to you, as a transaction undertaken by you or on your behalf.
- To participate in any offer made by a Merchant, you will have to go through the procedure set out in Gobbler's website to confirm your participation and to make payment to us. However, the transaction is not complete until and unless you receive from Gobbler via email and/or short messaging system ("sms") a computer-generated alphanumeric coupon code ("Coupon Code") that is unique and particular to that specific transaction, which serves as Gobbler's acceptance of the transaction. Upon the Coupon Code being sent by Gobbler to you, the transaction between you and Gobbler is complete.
- You acknowledge and accept that Gobbler is not acting as a trustee, fiduciary or escrow with respect to any monies paid by you to Gobbler in exchange for the Coupon Code.
- Redemption of the goods or service purchased in a completed transaction can be effected in one of two ways. You can choose to furnish to the relevant Merchant a printout of the Coupon Code email you received from Gobbler. Alternatively, you can show the Merchant the Coupon Code sms sent by Gobbler to you and your IC.
- As a user of the Service, it is your responsibility to keep your Coupon Code safe. Gobbler bears no responsibility should a third party gains access to your email account or your mobile phone and uses the Coupon Code.
- Each Coupon Code can only be utilized once to make redemption, so there can be no multiple redemptions for each Coupon Code furnished. Any attempt to redeem more than once any goods or service purchased can result in your account with Gobbler being immediately terminated, and would in addition constitute an offence which can result in prosecution.
- Redemption of the goods or service must be made in accordance with the Terms and Conditions. If any attempt is made to redeem the purchased goods or service in a manner that is not in accordance with the Terms and Conditions, Gobbler (or the Merchant concerned) has the full and unfettered discretion to treat the Coupon Code as void.
- You are aware and accept that the Merchant is the seller of the goods or service and is solely responsible for providing you with the goods or service that you have paid for the right to redeem. Gobbler is not an agent of the Merchant. Gobbler does not have any control over, and cannot be responsible or liable for, the goods or service that you are entitled to redeem through your use of the Services. Gobbler cannot ensure that a Merchant you are dealing with will actually complete the transaction. Recourse for any failure to redeem can only be made against the Merchant concerned. Gobbler welcomes feedback, but this should not be construed as Gobbler having a say or influence over or control in the manner in which each of the participating Merchants runs its business.
- In the event that you have a dispute with one or more of the Merchants, you release Gobbler (and its officers, directors, agents, and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes.
- For the avoidance of any doubt, Gobbler, its related entities, officers and employees, provide the Service "As Is" and without any warranty or condition, express, implied or statutory to the maximum extent permitted by law. Gobbler specifically disclaims any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement to the maximum extent permitted by law. Gobbler makes no representations or warranties regarding the amount of time needed to complete processing because the Services provided are largely dependant upon many factors outside of Gobbler's control, such as delays in the banking or telecommunication systems.
- In no event shall Gobbler, its related entities, officers and employees be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with Gobbler's website, the Services, or this Agreement (however arising, including negligence). If, notwithstanding the aforesaid, Gobbler is found by a court of competent jurisdiction to be liable to any User for any loss or damage, then in that event Gobbler's liability (and the liability of its related entities, officers and employees, if any) shall, in respect of each transaction or deal, be limited to the actual amount of payment collected from that User less the pro rata amount paid out by Gobbler to the Merchant in respect of that transaction or deal.
- You agree to indemnify and hold Gobbler, its related entities, officers and employees harmless from any claim or demand (including legal costs) made or incurred by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party relating to your use of the Services.
- You may close your account at any time by clicking on the relevant link in Gobbler's website. Upon closure of an account, any pending transactions will be cancelled and any balances associated with incentives provided for use of the Services will be forfeited. Any funds that we are holding in custody for you pending our acceptance of any uncompleted transaction at the time of closure, less any applicable fees, will be refunded to you. After the date of termination, we will use the information you provided to try to send you any funds that we are holding in custody for you. If that information is not correct, and we are unable to complete the payment to you, your funds will be subject to applicable laws regarding escheat of unclaimed property. You will remain liable for all obligations related to your account even after such account is closed.
- You agree to receive all communications from Gobbler in electronic form. Electronic communications may be posted on the pages within Gobbler's website and/or delivered to your e-mail address. You may print a copy of any such communications and retain it for your records. All communications in either electronic or paper format will be considered to be in "writing," and to have been received no later than 24 hours days after posting or dissemination, whether or not you have received or retrieved the communication.
- You agree that in the event of a dispute between you and Gobbler or you and any Merchant, Gobbler's electronic records of your transactions, this User Agreement, any identity verification information provided in a paper format and subsequently scanned or otherwise converted into an electronic format, and any other information stored or created electronically shall be admissible in a court of law or in relation to a law enforcement or regulatory investigation or prosecution.
- This Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore, and both parties hereby agree to submit to the exclusive jurisdiction of the Singapore courts.
